The German federal government is preparing a bill that will remove the main barrier to the repatriation of ethnic Germans. We are talking about the so-called “1993+ rule”. If previously the right to move along the line of late repatriates was automatically cut off for those born after 01.01.1993, now the situation is changing.
The federal government commissioner for repatriates Bernd Fabricius confirmed in an interview with the Bundeszentrale für politische Bildung that amendments are being prepared that will allow ethnic Germans under 32 years of age to move to Germany directly for Niederlassungserlaubnis (permanent residence).
What does the new bill provide?
- Legal entry and residence in Germany.
- The right to employment without additional quotas.
- Social benefits and health insurance according to the GKV system standard.
- Full right to integration into society – from language courses to support in the labor market.
It is immediately emphasized: citizenship is not granted to new immigrants. But the permanent residence status itself removes the main risk – the need for temporary visas or a limited residence permit.
Requirements remain strict
The law does not cancel the basic conditions:
- confirmed German roots (genealogical documents, archival certificates);
- proficiency in German from B1 (according to the Common European Framework of Reference for Refugees CEFR);
- no criminal record;
- correctly collected package of documents.
Why is this step important
According to the Statistisches Bundesamt, more than 2.9 million people with Russian-German origin live in Germany today, and their share in the migration structure remains one of the most significant. In 2023, the number of applications for late repatriates was only 8,900, compared to 200,000 annually in the early 2000s. The reason is that the “1993 threshold” deprived an entire generation of opportunities.
The German press has already dubbed the reform “Spätaussiedlung 2.0”. According to the IW Köln research center, this decision is capable of returning young workers with the qualifications and knowledge of the language of the original country to Germany. Economists say directly: “The German labor market is already experiencing a shortage of specialists – more than 1.7 million vacancies remained unfilled in 2024” (Bundesagentur für Arbeit).
When to expect changes
The amendments are planned to be submitted to the Bundestag in the coming months. The CDU/CSU supported the initiative, which means the likelihood of the law being passed is high.
